The city has started to forfeit vehicles associated with DWI in Santa Fe, NM. Forfeiture means the city will take your vehicle and sell it at auction. The city ordinance allows forfeiture after an arrest for DWI or Driving While Suspended or Revoked. The city of Santa Fe may also try to forfeit your vehicle if you loaned it to someone else who was subsequently arrested for DWI.

Because this law is new, there are many ways to challenge the forfeiture. You must request an administrative hearing immediately, and consult with an attorney. Am I an innocent owner? Can the city keep my car while the case is pending? Is forfeiting my car constitutional? These questions and many more should be evaluated in every case. Please call Aaron J. Boland for a free consultation.
